Growency Express Policies

Growency Express is a New York-based business selling products through Amazon’s online marketplace. The following policies govern your use of our storefront and purchases made through Amazon. By accessing or purchasing from our storefront, you agree to these terms.
1. Terms and Conditions

Acceptance: Use of our Amazon storefront and purchase of products constitutes acceptance of these Terms and Amazon’s policies.

Product Information: Products are sold “as is.” Descriptions, images, and pricing are provided in good faith but may contain errors or omissions.

Orders: All orders are subject to availability and acceptance. Growency Express reserves the right to cancel or limit orders for any lawful reason.

Intellectual Property: All content, logos, and product names are owned by Growency Express or licensors. Unauthorized use is prohibited.

Prohibited Use: You may not misuse the Storefront, interfere with Amazon’s platform, or attempt unauthorized access.

Disclaimer of Warranties: Products and content are provided “as is” without warranties, except as required by law or Amazon policy.

Limitation of Liability: Growency Express is not liable for indirect, incidental, or consequential damages. Total liability is limited to the purchase price paid.

Governing Law: New York law governs these Terms, except where preempted by federal law or Amazon policies.
2. Shipping Policy

Platform Governance: Amazon controls all orders, shipping, and delivery times. In case of conflict, Amazon policies apply.

FBA Orders: Fulfilled by Amazon; Amazon manages storage, shipping, and tracking.

FBM Orders: Fulfilled by Growency Express; processed within 1–3 business days, excluding weekends and holidays. Tracking is provided via Amazon.

Carriers: FBM orders ship via USPS, UPS, FedEx, or other carriers. Growency Express is not responsible for carrier delays or errors.

Shipping Restrictions: Orders may only be shipped to Amazon-supported addresses; some products may have regulatory or size restrictions.

Lost or Damaged Packages: Contact Amazon customer service for FBA orders. Growency Express will cooperate for FBM orders in accordance with Amazon policy.
3. Refund Policy

Amazon-Controlled Refunds: All refunds and returns are subject to Amazon policies. Amazon policies govern in case of conflict.

FBA vs FBM: FBA refunds are managed by Amazon. FBM refunds are processed by Growency Express via Amazon’s system.

Category Exclusions: Certain items may be non-returnable, including:

Consumables (food, beverages, supplements)

Personal care or hygiene products

Health or safety-sensitive items

Clearance or final-sale items

Damaged or Defective Items: Report issues through Amazon; Growency Express will cooperate in good faith.

Refund Method: Refunds are issued to the original payment method; timing is controlled by Amazon or your financial institution.

Limitation of Liability: Refunds are limited to the purchase price. Growency Express is not responsible for delays or errors by Amazon.

New York Consumer Rights: This policy complies with NY General Business Law §218-a and other applicable consumer protections.
4. Privacy Policy

Data Collection: Growency Express does not collect payment or personal data directly; Amazon handles all transactions.

Use of Information: Growency Express may receive limited order and shipping information via Amazon to fulfill orders and resolve issues.

Sharing of Data: Personal information is never sold. Shared only with carriers, Amazon, or required by law.

CCPA/CPRA Rights (California Residents): Customers may request access, deletion, or opt-out rights via Amazon or Growency Express through Amazon messaging.

Growency Express is committed to accessibility and will make reasonable efforts to provide information in an accessible format.
