Growency Express

These Terms and Conditions (“Terms”) govern your access to and use of the Growency Express storefront and products offered through Amazon’s platform (the “Storefront”). By accessing our Storefront or purchasing our products, you agree to be bound by these Terms, as well as WIX and Amazon’s applicable Terms of Service, policies, and guidelines.

If you do not agree with these Terms, please do not use our Storefront.

Growency Express is a business based in New York that offers products for sale through Amazon’s online marketplace. Growency Express does not own, operate, or control the Amazon website or platform.

2. Platform Governance (Amazon)

All transactions, payments, account management, shipping options, returns, and customer data processing are handled through Amazon and are subject to Amazon’s:

  • Privacy Notice

  • Return, Refund, and Shipping Policies

In the event of any conflict between these Terms and Amazon’s policies, Amazon’s policies shall control.

We make reasonable efforts to ensure that product descriptions, images, and pricing are accurate. However:

All orders placed through the Storefront are subject to acceptance and availability. We reserve the right to:

  • Limit quantities purchased per customer or order

Order confirmations are provided by Amazon and do not constitute acceptance until the order has been processed and shipped.

Shipping, returns, exchanges, and refunds are governed primarily by Amazon’s policies. Growency Express complies with Amazon’s applicable fulfillment and return requirements.

7. Prohibited Use

You agree not to:

  • Use the Storefront for any unlawful or fraudulent purpose

  • Interfere with the operation or security of WIX or Amazon’s platform

  • Misuse or attempt to gain unauthorized access to systems or data

Any misuse may result in denial of access or other actions permitted by law or Amazon/WIX policy.

8. Disclaimer of Warranties

To the fullest extent permitted by law:

  • Products and content are provided “as is” and “as available”

  • Growency Express disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose

  • We do not guarantee uninterrupted or error-free access to the Storefront

Some jurisdictions do not allow certain warranty disclaimers, so some limitations may not apply to you.

To the maximum extent permitted by law:

  • Growency Express shall not be liable for any indirect, incidental, consequential, special, or punitive damages

  • Growency Express’s total liability for any claim arising out of or related to products purchased through Amazon/WIX shall not exceed the amount paid for the product giving rise to the claim

  • We are not responsible for issues caused by WIX/Amazon’s platform, systems, or services

You agree to indemnify and hold harmless Growency Express from any claims, damages, losses, or expenses arising out of your misuse of the Storefront or violation of these Terms or applicable laws.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles, except where preempted by federal law or WIX/Amazon’s governing terms.

12. Changes to These Terms

Growency Express reserves the right to modify or update these Terms at any time. Changes will be effective upon posting to the Storefront or associated listings. Continued use of the Storefront constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
