Growency Express
(New York Consumer Protection, Amazon Fulfillment & Category Exclusions Aligned)

Growency Express and Growency Events (“Growency”) is a New York–based business offering products through Amazon’s online marketplace, planning, and coordination services. This Refund Policy explains how returns, refunds, cancellations, and exchanges are handled for both Amazon purchases and Growency Events.

1. Governing Platforms

Amazon Purchases:
All product purchases are processed through Amazon and are subject to Amazon’s Return, Refund, and Fulfillment Policies. If there is any conflict between this Refund Policy and Amazon’s policies, Amazon’s policies shall control.

Growency Events:
Event registrations, planning, and coordination services are governed by this Refund Policy and any additional terms disclosed at the time of booking or registration.

2. New York “No-Refund Posted Notice” (GBL §218-a)

In accordance with New York General Business Law §218-a:

  • Refund terms are clearly disclosed in this policy and/or at the point of purchase or registration

  • Where refunds are limited or not offered, such limitations are disclosed in advance

  • Nothing in this policy limits any non-waivable consumer rights under New York or federal law

  • Where required by law, Growency will honor applicable statutory refund rights

3. Amazon Product Refunds

A. Fulfilled by Merchant (FBM):

  • Returns are initiated through Amazon

  • Growency processes returns in accordance with Amazon policies

  • Approved refunds are issued through Amazon to the original payment method

4. Product Category Exclusions & Limitations

To the fullest extent permitted by Amazon policy and applicable law, certain items may be non-returnable or restricted (except if defective, damaged, or required by law), including:

  • Consumables: food, beverages, supplements, or perishable goods

  • Personal care & hygiene items: skincare, grooming, or products that contact skin

  • Health or safety-sensitive items: sealed or regulated products once opened

  • Final sale or promotional items: marked “Final Sale” or “Non-Returnable”

All limitations are subject to Amazon’s policies and disclosures at the time of purchase.

5. Growency Events – Refunds & Cancellations

A. Event Registrations (General):

  • Unless otherwise stated, deposit may be non-refundable

  • Refund eligibility, if offered, will be disclosed at the time of registration

B. Cancellations by Attendee:

  • Requests must be submitted using the contact method provided at registration

  • Approved refunds (if applicable) may be subject to deadlines, processing fees, or partial refunds

C. Cancellations or Changes by Growency:

  • We reserve the right to cancel, reschedule, or modify contract with proper communication

  • If a service is canceled by Growency, remedies may include:

    • Rescheduling

    • Credit toward a future event

    • Refunds, where applicable

D. No-Shows:

  • Failure to attend an event does not guarantee a refund or credit

6. Planning & Coordination Services

For event planning, coordination, or related services:

  • Deposits may be non-refundable once services have commenced or resources have been allocated

  • Cancellation terms, payment schedules, and refund eligibility will be outlined in the applicable service agreement

  • Partial refunds, if any, are determined based on work completed, costs incurred, and contractual terms

7. Damaged, Defective, or Incorrect Products

If you receive a product that is damaged, defective, or incorrect:

  • Report the issue through Amazon’s return or support system promptly

  • Amazon may request documentation (e.g., photos)

  • Growency will cooperate in resolving the issue in accordance with Amazon policies and applicable law

8. Refund Method and Timing

  • Amazon purchases: Refunds are issued to the original payment method via Amazon

  • Events/Services: Refunds (if applicable) are issued via the original payment method or agreed alternative

  • Processing times may vary and may depend on Amazon, payment processors, or financial institutions

  • Growency does not control third-party processing timelines

9. Exchanges

  • Amazon products: Typically handled as a return and replacement order via Amazon

  • Events: Transfers to another event may be allowed only if explicitly stated

10. Limitation of Liability

To the fullest extent permitted by law:

  • Growency is not responsible for refund determinations or delays caused by Amazon or third-party platforms

  • Refunds are limited to the amount paid for the product, event, or service (excluding fees unless required by law)

  • Growency shall not be liable for incidental, indirect, or consequential damages

11. No Additional Guarantees

This Refund Policy does not create warranties or guarantees beyond those required by Amazon’s policies, service agreements, or applicable law.

12. Policy Updates

Growency reserves the right to modify this Refund Policy at any time. Changes are effective upon posting to the Amazon storefront, event pages, or related materials.
