Growency Express
(New York Consumer Protection, Amazon Fulfillment & Category Exclusions Aligned)
Growency Express is a New York–based business offering products for sale through Amazon’s online marketplace. This Refund Policy explains how returns, refunds, and exchanges are handled for purchases made through our Amazon storefront.
1. Governing Platform
All purchases are processed through Amazon’s platform and are subject to Amazon’s Return, Refund, and Fulfillment Policies.
If there is any conflict between this Refund Policy and Amazon’s policies, Amazon’s policies shall control.
2. New York “No-Refund Posted Notice” Fallback (GBL §218-a)
Under New York General Business Law §218-a, if a seller does not conspicuously post a refund policy, consumers may be entitled to a refund within a specified period.
Growency Express hereby provides notice that:

Refunds and returns are governed by this policy and by Amazon’s posted return policies, which are displayed prior to purchase

Where a return or refund is not offered for a specific product category, such limitation is disclosed below and/or on the product listing

Nothing in this policy is intended to limit any non-waivable rights available to consumers under New York or federal law
Where required by law, Growency Express will honor applicable statutory refund rights.
3. Fulfillment Method Determines Refund Handling
A. Fulfilled by Amazon (FBA)
For items marked “Fulfilled by Amazon”:

Amazon handles storage, shipping, returns, refunds, and customer service

Refund eligibility, approval, and timing are determined by Amazon

Returns must be initiated through the customer’s Amazon account
Growency Express does not control refund determinations for FBA orders.
B. Fulfilled by Merchant (FBM)
For items marked “Fulfilled by Merchant”:

Returns and refunds are initiated through Amazon
-
Growency Express processes returns in accordance with Amazon FBM policies
-
Approved refunds are issued through Amazon to the original payment method
4. Category-Specific Exclusions & Limitations
To the fullest extent permitted by Amazon policy and applicable law, the following categories may be non-returnable, non-refundable, or subject to additional limitations, except where defective, damaged, or required by law:
A. Consumable Products
Including but not limited to:

Food or beverage items

Supplements
-
Single-use or perishable goods
These items are generally not eligible for return once opened or used, due to safety and hygiene considerations.
B. Personal Care & Hygiene Products
Including but not limited to:

Skincare, haircare, grooming, or cosmetic products

Products that come into direct contact with skin or hair
Returns may be restricted if the product has been opened, used, or tampered with.
C. Health-Related or Safety-Sensitive Items
Items that are regulated, sealed for safety, or intended for personal use may not be eligible for return once opened.
D. Clearance, Final Sale, or Promotional Items
Items marked as “Final Sale,” “Non-Returnable,” or similar on the Amazon listing may not be eligible for refund unless required by law.
All category restrictions are subject to Amazon’s return policies and any disclosures made at the time of purchase.
5. Damaged, Defective, or Incorrect Items
If you receive an item that is damaged, defective, or materially different from the description:

Report the issue promptly through Amazon’s return or support system

Amazon may request photos or additional documentation

Growency Express will cooperate in good faith to resolve the issue in accordance with Amazon policies and New York law
6. Refund Method and Timing

Processing times vary and are controlled by Amazon and financial institutions

Growency Express does not control refund processing timelines
7. Exchanges
Exchanges are generally handled as a return followed by a replacement order through Amazon. Replacement availability is not guaranteed.
8. Limitation of Liability
To the fullest extent permitted by New York and federal law:

Growency Express is not responsible for refund delays or determinations made by Amazon

Refunds are limited to the purchase price paid for the product, excluding shipping, handling, or taxes unless otherwise required by law

Growency Express shall not be liable for incidental or consequential damages related to returns or refunds
9. No Additional Guarantees
This Refund Policy does not create any additional warranties or guarantees beyond those required by Amazon’s policies or applicable law.
10. Policy Updates
Growency Express reserves the right to modify this Refund Policy at any time. Changes will be effective upon posting to our Amazon storefront or product listings.
